Are You Ready to Start a Weight Loss Program

By C Lynn Beebe Most people will regularly say they need to lose weight. Many of these same people start one or more weight loss program each year. However, few of them give any thought to whether they are actually ready to begin such a program. You may be thinking that anyone who wants to lose weight must be ready to start a diet. If they weren’t, they wouldn’t want to lose weight in the first place, right? Being ready to start losing weight requires that one be in the proper mindset or it is nearly impossible to achieve success. By having the proper mindset, or attitude, toward weight loss it is much easier to maintain the motivation necessary to stick with a program. So how does a person know if they have the mindset required for success on their weight loss plan? The first step is to make a list of all the reasons for losing weight that matter to the person who will be losing the weight. Good reasons for losing weight for one person may not carry enough meaning for someone else to make a difference. Once a list has been made, the potential dieter needs to decide how important these reasons are. If they fall in the “would be nice” category they are probably not strong enough to provide any motivation for staying on a plan for very long. However, if they represent a dream or something the person has always wanted, there is a better chance of reaching the necessary level of motivation for a successful weight loss program. If the reasons are valid and meaningful, the next step is to set some goals. Normally a goal for someone wanting to lose weight will be “I want to lose weight” or “I want to lose thirty pounds.” While this may be a good start, it is not nearly specific enough. An overall long-term goal might be “I want to lose thirty pounds in six months.” When a big picture goal has been set it is time to break that goal down into smaller pieces and set sub-goals. Setting smaller, more manageable goals will result in a greater likelihood of success. Each sub-goal should be in writing and list specific results to be achieved, the steps necessary to be taken and the time frame required. Goals should be reviewed at the beginning of each day as a reminder of what needs to be done and they should also be revisited at the end of the day to verify that everything was accomplished. Momentum will be gained with every success realized from reaching the sub-goals which will result in continued motivation. Having goals and putting them into a written plan provides both a roadmap and a sense of accountability for someone on a weight loss program. Be sure that any weight loss program you consider includes a motivation component. While diet and exercise are certainly important and must be addressed as well, having the proper motivation is a preliminary requirement for expecting success with a new weight loss program. Chooks � The Organic Gardener’s All-Rounder

By Julie Williams Chooks (chickens) have been domesticated for many centuries. They originate from the Malaysian rainforests so they love to free-range. Chooks are such easy animals to care for, can make great pets for children and are a valuable resource for the organic gardener. Youll need to check with your local council to find out their regulations. Some councils wont allow you to keep any poultry, whereas others willsome even allow roosters. Some of the benefits of keeping chooks: - they supply you with beautiful, fresh eggs - daily - your left overs will never go in the bin again (reduces waste) - provide you with an excellent fertilizer base - they dig over the soil (so you don’t have to) - they reduce insect numbers; great for around your orchard - provide you with live entertainment Basic requirements * Dry, fox proof shelter * A safe place to lay eggs and hatch chicks (if you have a rooster) * A roosting perch off the ground (allow about 20cm per bird) * Layer pellets (or crumble for chicks) should make up the majority of their diet. * Kitchen scraps are great for variety * Wheat, corn or other grains should be offered occasionally, but not form the majority of their diet * Birds have no teeth; they swallow small pebbles or grit to grind down their food in their gizzard. They must have access to a supply of grit for this purpose. * Never feed chocolate, coffee, avocado or rhubarb, as they are toxic to chooks * They must always have access to clean, fresh water. If you dont plan on letting your chooks free range in a garden area during the day, they will be much happier if you provide them with an outside run where they will be able to scratch at the ground and enjoy the sunlight. I lock my chooks up from sunset to about midday. This way theyve almost always laid their eggs by then, so that I dont have to go on a daily egg hunt! Old grass-catchers from lawn movers make great laying boxes just the right size and they offer ventilation. Liquid Fertilizer Chook manure is a great base for a liquid fertilizer or to add to your compost heap. You never use it fresh though, as bird manure also contains their urine and will burn your crops. To make a liquid manure, place it in a porous bag in a bucket and fill the bucket with water. After about three weeks or so you can use the water on and around your plants, diluted to look like weak tea. Chook Manure for Compost If you provide a litter of straw, hay or sawdust in your chooks living quarters they will turn it into great compost material for you. They will scratch it, add manure and turn it over. You can add layers of this organic matter to your compost heap or leave it to turn into a fine, dark substance. The Franchise Agreement and The Promotional Fund with Franchisee Contributions

By Lance Winslow The world a franchising is quite an industry full of litigation. One of the favorites of franchisee attorneys in class-action lawsuits used to sue the franchisor for misuse of the promotional funds, which the franchisees have contributed to. There are a number of huge cases with large settlements, some of which have nearly bankrupted the franchisee company. It is for this reason that I decided to upgrade the clauses in our franchisee agreement and the information on the promotional fund and its contributions in the confidential operations manual. Here below is a copy of the clauses that I inserted into my franchisee companys franchise agreements; 2.3 Promotional Fund 2.3.1 Franchisee Contributions Franchisee will pay to Franchisor each month as a contribution to a Car Wash Guys System promotional fund (the Promotional Fund), if and when established, one hundred dollars ($100) per calendar month. Promotional Fund contributions are due and payable in full at the same time and in the same manner as continuing royalty fees. Payments of Promotional Fund contributions are not refundable. 2.3.2 Use Franchisor will not commingle Promotional Fund contributions with its general funds, but will hold all Promotional Fund contributions from all its Franchisees in one or more designated accounts. The Promotional Fund may be used as determined by Franchisor: (a) to purchase national, regional, and local advertising in broadcast, print, internet and electronic media; (b) to be used exclusively to meet any and all costs of maintaining, administering, researching, directing and preparing advertising and/or promotional activities (including, among other things, the costs of preparing and conducting television, radio, magazine, newspaper and internet advertising campaigns); direct mail and outdoor billboard advertising; marketing surveys and public relations activities; use of advertising agencies and website developers to assist with projects, website development and maintenance and internet informational and advertising links and promotional brochures, CD-ROMs, video tapes and other marketing materials for the Franchisor. (c) to acquire the services of in-house and outside advertising, public relations professionals and website developers; (d) to carry on other advertising and promotional activities as Franchisor may reasonably deem advisable to increase demand for Services offered by its Franchisees, whether Core Services or Optional Services; and (e) to pay the reasonable expenses of administering the Promotional Fund, including the reasonable compensation of Franchisors employees and expenses of the advisory committee described in Section 2.3.3 (if established by Franchisor) while working on behalf of the Promotional Fund. 2.3.3 Administration The Promotional Fund will be administered by the Franchisor or by an advertising agency selected by the Franchisor. Franchisor, in its sole discretion, may establish a Franchisee advisory committee from time to time to provide input and suggestions regarding use of the Promotional Fund and the effectiveness of programs funded by the Promotional Fund. If the Franchisee advisory committee is appointed, it will consist of representatives of Franchisor and representatives of the Franchisees, with the representatives of Franchisees constituting a majority of the members thereof. Franchisor shall retain sole discretion over the use of the Promotional Fund. 2.3.4 Accounting Franchisor will account to Franchisee annually for all Promotional Fund contributions received and spent. The accounting will be made by written report within ninety (90) calendar days of the end of the year setting forth the total contributions received from all Car Wash Guys System Franchisees as a group and all expenditures made by Franchisor, together with the balance on account in the Promotional Fund as of the date of the report. 2.3.5 Commercial Relationship Franchisor and Franchisee agree that the rights and obligations of the parties arising from the Promotional Fund and all related matters are governed solely by this Agreement, and that this Agreement and the Promotional Fund are not in the nature of a trust, fiduciary relationship, or similar special relationship. Franchisor and Franchisee agree that the Promotional Fund and this Agreement are based on an ordinary commercial relationship between independent businesspersons. ——– ———- ———– Every franchisor who has a promotional fund which is paid into by the franchisees must pay special attention to this issue to keep from being sued. Life is too Short, Don’t Have Regrets, Save your Marriage Today

By Terry Ross When we start out we have a very innocent outlook on life. Our vision of adulthood is seen through rose tinted glasses with freedom, money and the happy ever after in the forethought of our mind. When we are young we cant even comprehend how quickly life passes us by. Twenty five year olds are ancient, teachers have lived for ever and as for a grand parents we cant ever imagine being that old. As the years go by we soon realise that twelve months becomes shorter and shorter, no sooner does the summer start then its back to winter, Christmas and the cycle starts over again. Once you hit thirty those years just fly by, you get older quicker and quicker and you soon realise that life isnt everlasting. We are visitors on this planet for but a short period of time and if you keep on looking for that miracle way, way in the future you will miss the best part of your life. Realising how little time we have, puts a whole new perspective on life and makes you realise how precious life is. Now if you consider your relationship, do you really want to waste the best years of your life on failed relationships, one parent lifestyles and lonely nights? Save your marriage before it’s too late! Historically we didnt really have a choice. I always remember my Gran. She didnt have any real enjoyment in life, she just lived to serve her first husband and, once he died, her second. There was no give and take in either relationship neither husband believed she should have any enjoyment in life, in their eyes her sole aim in life was to wait on them hand and foot and just work like a slave. There was no decision to be made as to whether or not she wanted to save her marriage, marriage was for life. I worked with a guy once who believed that women should be no more than secretaries, if they worked at all, and that whenever he went home be it morning, lunch or night his meal should be ready and waiting!! Of course, times have changed, although that last example wasnt so long ago, and it is widely accepted that we no longer have to remain in relationships that are not working or if we dont feel like it. Marriage is no longer sacred to be clung on to no matter what but the disappointing change is that things have gone too far the other way with people giving up on relationships without a fight. I think the lesson we need to learn is that marriage is sacred but not at any cost. Life is very short and the grass is rarely greener on the other side. Always appreciate what you have got rather than setting your sites on a fairy tale. Marriage is a two way street, its all about give and take. Marriage is a changing target, like life, it is continually evolving and the ground rules keep changing but that doesnt mean that you cant learn to change with it. If you imagine the workplace the flexible workers, those who are prepared to learn and adapt to new processes and new ways of working are usually the ones who are successful. Marriage is the same. The most successful marriages are where partners learn to accept that times change, life doesnt stand still and if you want to get the best out of your relationship you need to adapt and move with the times. Your Durable Power of Attorney May Need to Be Replaced

By Gabriel Heiser Many of my clients come in with a “durable” power of attorney, believing they are all set with it. However, after carefully reviewing it, I invariably have to recommend they need a new one. Why is that? First of all, if the power of attorney is more than five years old, many financial institutions may simply refuse to honor it, believing that it may have been revoked. You may not realize it, but some states even provide that any person who arbitrarily or without reasonable cause refuses to comply with the directions of the agent named in a valid power of attorney will be liable for costs, expenses and attorney’s fees to appoint a conservator or go to court to enforce the power of attorney. Unfortunately, even if the law says they must follow the power of attorney, it could be a time-consuming and expensive proposition to force them to do so. A better idea is simply to sign an updated one every few years. Second, most power of attorney documents do not permit gifting by the agent named in the document, or if they do, it is handled all wrong! Some documents limit gifts to the federal gift tax annual exclusion (currently $12,000 per person per year) or prohibit gifts to the person serving as the agent. While those provisions may be useful for a wealthy client, they can really hinder effective Medicaid planning. In fact, it would be better if the document said nothing at all about gifting than include such limitations, because it’s always possible to go to court to get permission to make large gifts for Medicaid planning purposes, but once the judge sees those limits in the power of attorney document, he might not permit it. So what are the “must have” provisions to include in a durable power of attorney? It should specifically address gifting for Medicaid planning purposes. It should permit gifts to the agent, perhaps by someone other than the agent. It should include the power to purchase a “Medicaid annuity” and make a loan secured by a Medicaid-friendly promissory note. It should include at least one successor or back-up agent. It should include many powers you think you don’t need but may well need in the future! In short, the cheap or free forms you get at the office supply store or online are false bargains. Spend the small fee it costs to get a good power of attorney, one that includes the important provisions discussed above. In the long run, it could save your family thousands of dollars. Maybe you would make the sacrifice if you could find what you need. Most so called teacher stores have an abundance of everything except bulletin board materials. Their limited supply usually consists of a few extremes. The materials are extremely lacking in content, extremely commercial looking, and extremely costly. Then you have to decide whether or not you are going to settle for something you really don’t want. You could probably make your own materials if you just had the time. Finding time to make bulletin boards always been a struggle for teachers. They are a must have; but teachers must have time to do them. Most teachers never have enough have time to do them. They should be fun to do. Instead they are often a source of stress. Stress comes from first of all deciding what you are going to put on your boards. Do you have the materials on hand that you need. Making the boards require tracing letters and cutting them out. A very arduous and time consuming task. You must do this at home or after school. The next arduous task is finding pictures that are appropriate for your bulletin board. Laminating the letters and cutting them a second time. Laminating and cutting out pictures and borders. I have seen teachers take weeks to get one bulletin board done. Most teachers have at least two and sometimes three bulletin boards to decorate. Over a period of days or weeks you manage to finish. You sit down and know that you are done for at least another month. The principal comes into your classroom,admires your bulletin board and asks you if you would decorate the one in the hallway. Well, that did it. You start to seriously think about retirement. Relax, don’t quit. Ready made, printable classroom bulletin boards are at your service. That’s right. Just go to your computer and print them out. Most of them will print out in a title banner that has to be scotch taped at the seams. Accompanying lesson sheets that match do not have to be taped. Just print them out and put them on your bulletin board. The bulletin board materials should be laminated for longer wear. Take them to your classroom(or principals office) and put them up in five minutes. Printable bulletin boards for teachers are the best thing since sliced bread.
